New Visa Policies Aimed at Benefiting Foreigners • Shanghai

Shanghai’s policies mostly revolve around providing permanent resident permits for exceptional foreign individuals, and their families, who hold managerial positions, and for individuals who are ethnically Chinese with foreign nationality and working in Shanghai. While these policies may not seem as beneficial for all types of talented foreign nationals, the policies still offer significant advantages to those who fit the criteria. Overall the policies are aimed to facilitate those working in particular industries of interest such as Legal, Finance, Education and High-Tech while going further for ethnic Chines individuals with a foreign nationality specifically working in the “Double Zones” or “Double Innovation” Areas.

 

Policies Regarding the Acquisition of the Permanent Resident Permit

  1. Those who have won a Shanghai “Honorary Citizen,” “Magnolia Gold Award” or “Magnolia Silver Award”;

 

  1. Legal representatives, general managers, deputy general managers and chief financial officers of high-tech enterprises, encouraged foreign-invested enterprises, foreign-invested advanced technology enterprises and foreign-invested goods-exporting enterprises;

 

  1. Legal representatives, general managers, deputy general managers and chief financial officers of regional headquarters (or headquarters-type organisations) of multinational corporations in Shanghai, R&D centres and investment companies;

 

  1. Foreign experts and scholars invited by key institutions of higher learning and research institutes, and well-known enterprises in China;

 

  1. High-level foreign management and professional and technical talents certified by the competent department of human resources and the competent department of scientific and technological innovation in Shanghai;

 

  1. Foreign members of the innovation and entrepreneurship teams that are introduced by individuals in key development fields and industries in China;

 

  1. Foreign members of the work teams that are led by foreigners who have made significant contributions and are of particular demand in China.

 

  1. Foreign high-level technical talents with five-year tenure;

 

  1. Legal representatives, general managers, deputy general managers and chief financial officers of enterprises with registered capital of more than USD three million;

 

  1. Those who have been granted a one-year (or above) residence permit for work in Shanghai for two consecutive times, and who have not violated laws or regulations;

 

  1. Ethnic Chinese with foreign nationality working in Shanghai;

 

  1. Those holding a Five-year Type A Work Permit for Foreigners;

 

  1. Those holding a Five-year (or above) Type L-B Shanghai Residence Permit;

 

  1. Legal representatives, general managers, deputy general managers and chief financial officers at the headquarters of private enterprises.

 

Permanent Residence for Senior or Professional Staff

Applicants are eligible for permanent residence if they are employed in the following five types of organizations and hold positions of chairman, vice chairman, general manager, deputy general manager, or have titles of associate professor, associate researcher and above, and have worked consecutively for four years (residence in China no less than three years), and have good tax records:

 

  1. Research institutes of the State Council or Shanghai Municipal People’s Government or public institutions with administrative management or functions.

 

  1. Key universities (“211 Project” schools and the first batch of admissions colleges).

 

  1. Enterprises and institutions that undertake the task of national key projects or major scientific and technological projects.

 

  1. High-tech enterprises, encouraged foreign-invested enterprises, foreign-invested advanced technology enterprises or foreign-invested product export enterprises.

 

  1. Enterprises and institutions like national laboratories, national key laboratories, national engineering laboratories, national engineering research centres, national accredited enterprise technology centres, national engineering technology research centres, or foreign-funded R&D centres.

 

The foreign spouse and their unmarried children under 18 years old of the above foreign applicants can apply for permanent residence together.

 

Permanent Residence for Working Staff

Those who have worked in Shanghai continuously for four years with an annual salary income (before tax) exceeding RMB600,000, and have paid annual individual income tax exceeding RMB120,000, and stay in mainland China for no less than six months every year in this four years can apply for permanent residence in China with the present employer’s recommendation. The foreign spouse and their unmarried children under 18 years old of the above applicants can apply for permanent residence together.

 

Permanent Residence for Foreign High-level Talents

Foreign high-level experts (talents) who are accredited by a competent national or municipal administration, or employed by science and technology innovation companies designated by a competent department of Shanghai as professionals with expertise can apply for permanent residence in China with the present employer’s recommendation if they have acquired an employment-typed residence permit noted with “Talents” and have worked in Shanghai for over three years. The foreign spouse and their unmarried children under 18 years old of the above applicants can apply for permanent residence together.

 

Permanent Residence for Ethnic Chinese with a Foreign Nationality Working in “Double Zones”, “Double Innovation” Areas

Ethnic Chinese with a foreign nationality who work in Shanghai Zhangjiang National Innovation Demonstration Zone or China (Shanghai) Pilot Free Trade Zone (hereinafter called “Double Zones”), or in demonstration base of “mass entrepreneurship and innovation” (hereinafter called “Double Innovation”) area for at least four consecutive years, and have good tax records, and who live in mainland China for no less than six months each year can apply for permanent residence.

The foreign spouse and their unmarried children under 18 years old of the above foreign applicants can apply for permanent residence together.
