    This event will give an insight into how to do business in China and India. It will also show the comparisons between the two countries.

Harby Janagol started in a Chartered accountancy practice after which he joined a FTSE 100 telecommunications company. Harby held various positions including Finance, Strategy, Business Development, Sales and finally Account Director in Europe (managing contracts circa £500 million). Harby is a Director of Lehman Brown in the UK office advising European clients on market entry to China and India and provide ongoing financial and management accounting services.

    Members and friends at the Networking in Mandarin evening held on 29 May.

Having the largest presence in Asia of any global law firm DLA Piper LLP were delighted to host the first of the Networking in Mandarin events organised by our China Interest Group for members to learn some mandarin over drinks and canapés.

Lord Clement-Jones, Co-Chairman of Global Government Relations of DLA Piper Europe & Asia and also Vice Chairman of the UK All Party Parliamentary Group welcomed the guests warmly. Attendees included several members of the Chinese Students and Scholars Association studying at University College London and other London colleges.

Lord Clement-Jones was especially pleased to meet so many young Chinese academics and he is convinced that many of these dynamic graduates will contribute greatly to China’s future development, her political infrastructure and also her economic strategies.

The event provided an excellent opportunity for members of the China Interest Group to meet future Mandarins who are keen to learn from the success of the City’s financial and professional success.

Russell Brown, Managing Partner of LehmanBrown, spoke on “Doing business in China”, covering a wide range of topics from types of legal entities, tax considerations, foreign exchange and risks. He advised that, “Doing business in China is no different than doing business in any other country outside of your own; you need to be familiar with the business environment in order to reduce the risks associated with that particular country. Those who do their homework pass the exam so to speak.”

With China’s entry into the WTO and the opening up of the market, more businesses have expanded their operations into China, taking advantage of lower production cost and tax incentives that are offered to foreign invested enterprises (FIEs). Cross border transactions, such as imports, the sale of goods, the provision of services, or the transfer of equipment between related companies in China are increasing.

Over 2002 we have seen a significant increase in the amount of tax reviews and investigations performed by tax authorities in various locations in the People’s Republic of China. Senior officials from the State Administration of Taxation have repeatedly mentioned the seriousness of tax compliance problems of high-earning enterprises. It seems that transfer pricing issues are at the center of the Chinese tax authorities’ attention. This makes transfer pricing an essential element in business and tax planning.

PRC Accounting System for Business Enterprises

In January 2001, the Chinese Ministry of Finance ("MOF") adopted a comprehensive "Accounting System for Business Enterprises". As of January 2002, MOF extended the applicability of the new accounting system to foreign investment enterprises (FIE). The MOF has issued transitional provisions for FIEs to comply with the new system, including the application of 7 new standards.

Aside from these changes to basic Chinese Accounting Standards, the new system in itself provides a more rigorous and comprehensive financial reporting framework, covering definitions, concepts, standards, presentation and record keeping.
