What is the concept of receivership in China?
Where agreement can't be reached, court enforcement proceedings will be necessary. Proceedings will be initiated by statement of claim. When presented with the statement of claim, the relevant court will decide whether or not the court has jurisdiction to hear the proceedings. If the court decide the jurisdiction is relevant, the rights of the various creditors can be investigated and a hearing can take place.
Every effort will then be made to conclude the enforcement proceedings within six month of their first having been initiated.
